Rental Terms and Conditions

1. Definitions

In these terms and conditions:

  • “We,” “us,” “our” refers to Infinity Motorhome Rentals the owner and operator of the vehicle.
  • “You,” “your,” “the hirer” refers to the person(s) named on the rental agreement.
  • “Vehicle” refers to the motorhome hired under this agreement, including all fixtures, fittings, equipment, and accessories.
  • “Rental period” refers to the dates specified on the rental agreement, from pick-up to drop-off.
  • “Authorised driver” refers to any person named on the rental agreement as an approved driver of the vehicle.

2. Booking and Payment

2.1. A deposit of $500 is required to confirm your booking. The deposit is non-refundable if cancellation occurs within 7 days of pick-up.

2.2. The remaining balance must be paid in full no later than 28 days before pick-up during peak season (December–February) or 14 days before pick-up during the off-peak season (March–November).

2.3. If the balance is not received by the due date, we reserve the right to treat the booking as cancelled and retain the deposit.

2.4. We accept payment by major credit card (Visa, Mastercard) and direct bank transfer. Payment must be received in New Zealand dollars unless otherwise agreed.

3. Cancellation by the Hirer

3.1. Cancellations must be made in writing by email.

3.2. The following refund schedule applies, based on the number of days between the date we receive your written cancellation and the scheduled pick-up date:

  • 60 or more days: full refund of all amounts paid.
  • 28 to 59 days: 75% refund (25% of total rental retained).
  • 8 to 27 days: 50% refund.
  • 7 days or fewer: no refund.

3.3. Where possible, we may offer a date change within 12 months as an alternative to cancellation. Date changes are subject to vehicle availability.

4. Cancellation by Us

4.1. In the unlikely event that we need to cancel your booking due to circumstances beyond our control (including but not limited to mechanical failure, accident, or force majeure), we will offer you an alternative vehicle of equivalent or higher specification. If no suitable alternative is available, a full refund of all amounts paid will be provided.

4.2. Our liability in the event of cancellation by us is limited to a full refund of the rental amount paid. We are not liable for consequential losses such as flights, accommodation, or other travel arrangements.

5. Pick-up and Drop-off

5.1. The vehicle must be collected and returned at the agreed location and times specified on the rental agreement.

5.2. Late returns may incur an additional daily charge at the standard rental rate. If the vehicle is returned more than 2 hours late without prior arrangement, a full additional day will be charged.

5.3. You must present a valid driver’s licence and credit card in the primary driver’s name at pick-up.

5.4. A comprehensive vehicle walkthrough will be conducted at pick-up. Both parties will sign a condition report documenting the vehicle’s state. You are responsible for noting any pre-existing damage during this walkthrough.

6. Driver Requirements

6.1. All drivers must be at least 25 years of age and hold a full, current driver’s licence that has been valid for a minimum of two years.

6.2. International visitors whose licence is not in English must carry an official certified translation at all times while driving.

6.3. Learner licences and restricted licences are not accepted.

6.4. All drivers must be named on the rental agreement. Allowing an unlisted person to drive the vehicle voids all insurance coverage and constitutes a breach of this agreement.

7. Insurance and Liability

7.1. The standard rental includes basic insurance coverage with a liability of up to $7,500 per incident.

7.2. Optional excess reduction plans are available to reduce or eliminate your per-incident liability. Plan details are set out on our insurance page.

7.3. The excess applies per incident, not per rental period. Multiple incidents will each carry their own excess liability.

7.4. If the cost of repairs is less than the applicable excess, you will be charged only the actual repair cost.

7.5. Insurance coverage of any kind does not apply where damage or loss results from:

  • driving under the influence of alcohol or drugs;
  • driving in breach of any traffic law;
  • driving by an unauthorised or unlisted driver;
  • use of incorrect fuel type;
  • improper fitting or use of snow chains;
  • driving on restricted roads (see Section 9);
  • overloading the vehicle beyond its rated capacity;
  • negligence, recklessness, or wilful damage;
  • damage caused by pets;
  • any breach of this rental agreement.

8. Security Deposit

8.1. If you do not purchase an excess reduction plan, a refundable security deposit of $7,500 will be pre-authorised on your credit card at pick-up.

8.2. The deposit hold will be released within 10 business days of the vehicle being returned in good condition, provided no damage claim or outstanding charges are pending.

8.3. If you purchase an excess reduction plan, no security deposit is required.

9. Vehicle Use and Restrictions

9.1. The vehicle must be driven in a safe, lawful, and responsible manner at all times, in accordance with New Zealand road rules.

9.2. The vehicle must not be driven on:

  • any beach or tidal area;
  • Skippers Canyon Road;
  • unsealed ski-field access roads;
  • any road officially designated as unsuitable for large vehicles;
  • any road that is closed or restricted by local authorities.

9.3. Snow chains must be fitted when road conditions require them. Incorrect fitting that causes damage to the vehicle is not covered by insurance.

9.4. The vehicle must not be used for any commercial purpose, sub-let, or used in any competition, rally, or speed test.

9.5. Smoking inside the vehicle is strictly prohibited. A cleaning fee of $500 will be charged if evidence of smoking is found.

9.6. Pets are permitted only with prior written approval and payment of the $350 pet cleaning fee at the time of booking.

10. Your Responsibilities During the Rental

10.1. You are responsible for the safe keeping and proper operation of the vehicle throughout the rental period.

10.2. You must check engine oil, coolant, and tyre pressure at least once per week, or before any journey exceeding 500 km.

10.3. You must use the correct fuel type as specified during the vehicle walkthrough. Damage caused by incorrect fuel is your full responsibility regardless of insurance coverage.

10.4. You must observe all height, width, and weight restrictions for bridges, tunnels, car parks, and overhanging structures. Overhead and underbody damage caused by failure to observe restrictions is not covered by insurance.

11. Breakdowns and Mechanical Issues

11.1. In the event of a mechanical breakdown, contact us immediately. All vehicles are covered by 24/7 AA Roadside Assistance for mechanical faults.

11.2. A callout fee may apply for Roadside Assistance. If the breakdown is due to a mechanical fault and not driver error, we will reimburse reasonable callout costs.

11.3. Do not authorise any repairs or towing without our prior approval, except in an emergency where the vehicle is causing a safety hazard.

12. Accidents and Damage

12.1. In the event of any accident, collision, or damage — no matter how minor — you must:

  • ensure the safety of all persons involved;
  • contact emergency services if anyone is injured;
  • not admit liability or fault to any third party;
  • take photographs of all damage and the surrounding area;
  • obtain the names, contact details, and vehicle registration numbers of all parties involved;
  • contact us as soon as practicable;
  • file a police report if required by law or requested by us.

12.2. Failure to report an accident or damage promptly may void your insurance coverage.

13. Return Conditions

13.1. The vehicle must be returned by the agreed date and time. Late returns are subject to the charges described in Section 5.2.

13.2. Upon return, the vehicle must be:

  • reasonably clean inside and free of rubbish and personal belongings;
  • refuelled with diesel to the same level as at pick-up;
  • with black water and grey water tanks emptied.

13.3. If the vehicle is returned in an unreasonably dirty condition, a cleaning fee of up to $350 will be charged.

13.4. Road User Charges (RUC) are calculated at the rate of $9 per 100 km driven and will be invoiced at drop-off based on the odometer reading.

14. Fees and Additional Charges

14.1. The following additional charges may apply during or after your rental:

  • Road User Charges: $9 per 100 km driven.
  • Late return: one additional day’s rental per day or part-day.
  • Cleaning fee (excessive dirt): up to $350.
  • Smoking cleaning fee: $500.
  • Pet cleaning fee: $350 (payable at booking).
  • Lost keys: actual replacement cost.
  • Traffic and parking fines: actual fine amount plus a $50 administration fee.

15. Privacy

15.1. Personal information collected during the booking and rental process is used solely for the purposes of managing your rental, communicating with you about your booking, and meeting our legal obligations.

15.2. We will not share your personal information with third parties except where required by law, for insurance claims, or with your prior consent.

16. Limitation of Liability

16.1. To the fullest extent permitted by New Zealand law, our total liability to you for any claim arising from or connected to this rental agreement shall not exceed the total rental amount paid.

16.2. We are not liable for any indirect, consequential, or incidental losses, including but not limited to loss of enjoyment, missed flights, alternative transport costs, or accommodation expenses.

16.3. Nothing in these terms excludes or limits liability that cannot be excluded or limited under New Zealand law, including the Consumer Guarantees Act 1993.

17. Disputes

17.1. If a dispute arises, both parties agree to attempt to resolve it in good faith through direct communication.

17.2. If the dispute cannot be resolved directly, it will be referred to mediation under the Resolution Institute’s mediation rules. The costs of mediation will be shared equally.

17.3. This agreement is governed by the laws of New Zealand. The courts of New Zealand shall have exclusive jurisdiction over any dispute arising from this agreement.

18. General

18.1. This rental agreement, together with these terms and conditions, constitutes the entire agreement between you and us. No verbal promises or representations form part of the agreement unless confirmed in writing.

18.2. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

18.3. Our failure to enforce any right under these terms does not constitute a waiver of that right.

18.4. We reserve the right to update these terms and conditions. The version in effect at the time of your booking confirmation applies to your rental.
